The majority of the website is viewable without registration but visitors will need to register with the website in order to use some of the services or features made available. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects. Cellar Seller reserves the right to suspend or cancel your registration at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.
SALE OF ALCOHOLIC BEVERAGES
By placing a purchase order on our website, you certify to be over 18 years old, or that you have reached the legal age required in the country of your residence to be allowed to purchase or consume alcohol and that you are legally capable of entering into binding contracts.
CARRIAGE AND DELIVERY
Any delay for delivery will by no means be compensated, accounted nor enable the cancellation of the order. However, if the goods have not been delivered after one month upon the written claim provided by the customer, the sale could then be cancelled by either one of the parties.
The customer will then obtain the refund of his payment excluding any other compensation or damage, within a delay of maximum one month.
In all circumstances, the delivery of the goods within this delay can only be made if the customer has indicated the exact information, address and telephone contact of the addressee during the order process. If this information is not correctly communicated, Cellar Seller will not be liable for any further delay or non-delivery of the goods.
Upon reception of the wines, it is up to the addressee to check the state of the goods and to note any reserve concerning broken, damaged or missing goods on the delivery slip and to inform the delivery company and Cellar Sellar by email within 48 hours in order to preserve his/her rights.
PRICE OF GOODS
All prices quoted on the web site include taxes, unless otherwise stated. Our basic prices are indicated in Singapore Dollars. Payment is due upon Paypal’s approval.
Orders can only be paid through PayPal, where you would be directed to PayPal’s website for payment to be processed and all credit card details would be provided directly to PayPal. PayPal is an established and secure payment gateway provider; Cellar Seller does not capture any of your credit card details on its website should you make payment through PayPal.
Customers may cancel your order within 8 hours of placing your order on the Cellar Seller’s website, provided you have notified the Cellar Seller in writing before the delivery of the Goods has been made.
Cellar Seller reserves the right to cancel an order placed by you if
- Cellar Seller does not have sufficient stock of the relevant Goods to complete your order; or
- Cellar Seller has identified an error in the price or description of the Goods or
- On written notice by Cellar Seller, your order has been cancelled for a reason not listed above.
Products are subject to return or exchange only according to our Return Policy.
LIMITATION OF LIABILITY
In no event shall Cellar Sellar be liable to you or to any other person or entity in any way, whether arising under contract, tort (including negligence) or otherwise, for damages of any kind arising from the use of this website, including, but not limited to, direct, indirect, incidental, punitive or consequential damages, lost revenue or profits, lost or damaged data or other commercial or economic loss, that result from your use of, or inability to use, this website.
If this limitation of liability provision shall be deemed unenforceable, either in whole or in part, then such parts as are unenforceable shall be deleted, the remaining parts shall remain in full force and effect and Cellar Sellar’s liability shall be limited to the greatest extent permitted by law.
EVENTS OUTSIDE OF OUR CONTROL
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (“Force Majeure Event”).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
(a) Strikes, lock-outs or other industrial action.
(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
(c) Fire, explosion, storm, floor, earthquake, subsidence, epidemic or other Natural disaster
(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
(e) Impossibility of the use of public or private telecommunications networks.
(f) The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.
OTHER SERVICES AND PROMOTIONS
From time to time, Cellar Seller may offer other services, special offers, discounts, or promotions not specifically referred to in the terms and conditions provided herein. Such matters shall be subject, in addition to the terms and conditions provided herein, to additional terms and conditions. By accepting the services, special offers, discounts, or promotions, you agree to be additionally bound by such additional terms and conditions.
We may monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
